The above noted parties agree to the sale of the purebred Miniature Schnauzer described above, subject to the following terms and conditions:
Section A: Purchase, Registration and Transfer
That the Seller shall register the dog with the Canadian Kennel Club (CKC) and transfer ownership to the Buyer. The Seller shall forward the dog's individual registration papers to the Buyer as soon as possible after they are received from the Canadian Kennel Club.
That the Seller and Buyer shall sign and execute a Canadian Kennel Club Non-breeding Agreement, attached to this Agreement. Breeding this dog in contravention of that agreement shall render all guarantees null and void.
That the Seller shall provide the Buyer with a five generation pedigree.
Section B: Health
That this dog is in good health and free of communicable diseases to the best of the Seller's knowledge at the time of delivery and 72 hours thereafter. The Seller affirms that this dog has received initial vaccinations and worming appropriate to its age, and has been examined by a qualified veterinarian and opthamologist. The Seller will provide a current health care record at the time of delivery.
The Buyer is encouraged to take the dog to a licensed veterinarian within 72 hours of delivery for a health check, at the buyer's expense. If the veterinarian finds the dog to have a communicable or congenital disease or other serious health problem at that time, the Seller will:
a)replace the dog with another dog of comparable quality upon return of the dog, when one becomes available OR
b)reimburse the full purchase price upon return of the dog
The choice of a) or b) rests with the Buyer. The Buyer agrees to be fully responsible for the well being of the dog until it can be returned to the Seller, and that the dog will be returned in the same condition as when delivered. Evidence to the contrary will result in this guarantee being null and void. The Seller reserves the right to a second opinion from a veterinarian of their choice. If the dog is not examined by a veterinarian within 72 hours of delivery, the above return policy shall be null and void.
That the Seller has taken reasonable efforts to lessen the potential of serious genetic illness occurring in this dog. At a minimum, both parents will have had regular CERF eye examinations. All available health test results, on both parents, will be shared with the Buyer. To the best of the breeder's knowledge, neither parent is affected by any known genetic disease at the time of breeding.
That the Seller guarantees this dog shall remain free of serious inherited defects, that would affect its ability to function as a pet, throughout its lifetime. If any such defects develop, upon written verification by a qualified veterinarian and upon receipt of copies of all relevant documentation, the Seller shall refund the original purchase price or replace the dog with one of equal or greater value, whichever option the Buyer prefers. Return of the dog is optional. If the Buyer does not wish to return the affected dog, it must be spayed/neutered before a replacement will be provided. The Seller reserves the right to a second opinion from a veterinarian of their choice.
The Buyer agrees to assume responsibility for all health and veterinary care needs of this dog throughout its lifetime including the maintenance of the dog's vaccinations in accordance with the protocol established with their veterinarian.
This guarantee is null and void upon any evidence of abuse or neglect, in the opinion of the Seller. Chronic obesity, improper exercise and/or poor hygiene and grooming constitute neglect. To remain in effect, this dog must receive annual veterinary checkups and treatment as prescribed.
Section C:Temperament, care, and training
The Seller agrees that this dog has been temperament tested and has been socialized with other dogs and people.
The Buyer agrees to provide for the humane care and training of this dog throughout its lifetime.
The Buyer agrees to provide a safe and secure environment for the dog throughout its lifetime, including appropriate food and housing, within the Buyer's home. The Buyer agrees that this dog will not be permitted to run at large.
If the Buyer is not able to keep this dog for any reason at any point in its life, the Buyer agrees to return the dog to the Seller with a signed transfer of ownership. The Buyer agrees that the primary objective will be to find the best home for the dog and that the Seller is under no obligation to keep the dog or provide the Buyer with remuneration should it be sold. If the dog is sold, proceeds from the sale, minus the Seller's itemized expenses will be returned to the Buyer. Note: the monetary value of an adult pet animal is generally much less than the original purchase price.
The Buyer agrees to maintain occasional contact with the Seller so that the Seller remains informed on the health, well being, and accomplishments of the dog.
This Agreement is not transferable to a third party.
The Buyer and Seller agree that this is the full agreement. No other guarantees are made nor implied. Contravention or failure to fulfill the terms of this agreement shall render all guarantees null and void.
